1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Agreement" means these Terms and Conditions together with any service confirmation or letter of engagement.
- "Client" / "You" means the individual or entity engaging lumarila for advisory services.
- "lumarila" / "We" means lumarila, operating at 89 Jalan Merdeka, 88000 Kota Kinabalu, Sabah, Malaysia.
- "Service" means the property rental advisory services described on our website and in any service confirmation.
- "Website" means the website operated by lumarila at lumarilag.pro.
2. Acceptance of Terms
By submitting an enquiry, entering into a service agreement, or using our website, you confirm that you have read, understood, and agreed to these Terms and Conditions. You must be at least 18 years of age and have the legal capacity to enter into binding agreements. These terms are governed by the laws of Malaysia.
3. Service Description
lumarila provides residential property rental advisory services in Kota Kinabalu and the broader Sabah region. Our current service offerings include Smart Home Rental Advisory, Privacy-Focused Residence Search, and the Expatriate Transition Package. Each service is described in full on our website and confirmed in writing prior to commencement.
Services are available to individual clients aged 18 and above. We do not operate as a property listing platform; we act as an advisory intermediary on behalf of the client.
4. User Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your requirements and circumstances
- Respond to communications from our advisors in a reasonable timeframe
- Not share confidential property or landlord information obtained through our service with third parties
- Use any information provided by lumarila solely for the purpose of evaluating a tenancy for your own use
- Not engage directly with landlords introduced through our advisory process in a manner that circumvents our involvement, during the active engagement period
5. Fees and Payment
Our advisory services are offered at fixed fees in Malaysian Ringgit (MYR) as follows:
- Smart Home Rental Advisory: RM 2,450
- Privacy-Focused Residence Search: RM 3,400
- Expatriate Transition Package: RM 8,500
Fees are payable as agreed in the service confirmation. Payment details and methods will be set out at the time of engagement. Fees are exclusive of any applicable taxes unless stated otherwise.
Refund Policy
Where a service has not yet commenced, a full refund may be requested within 5 business days of payment. Once a service is underway, fees are non-refundable except where lumarila is unable to fulfil the agreed scope through no fault of the client. 6. Intellectual Property
All content on the lumarila website, including text, structure, and presentation, is the property of lumarila or its licensors. You are granted a limited, non-exclusive right to access and use the website for personal informational purposes. You may not reproduce, distribute, or commercially use any content without our prior written permission.
7. Disclaimers
lumarila's role is advisory. We provide research, assessment, and guidance to assist your decision-making, but the decision to enter into a tenancy agreement rests solely with you. We do not warrant that any property will continue to meet your requirements after placement, nor that landlords will maintain their properties as described.
Property market conditions can change. Information provided about specific properties reflects the state at the time of assessment and may not remain accurate thereafter.
Nothing on our website constitutes legal, financial, or immigration advice. For such matters, we recommend consulting qualified professionals.
8. Limitation of Liability
To the extent permitted by applicable law, lumarila's total liability to you in connection with any service shall not exceed the fee paid for that service. We are not liable for indirect, consequential, or incidental losses arising from your use of our services or website, including loss of income, loss of a tenancy opportunity, or costs arising from a failed placement.
9. Indemnification
You agree to indemnify lumarila against any claims, losses, or expenses arising from your breach of these Terms and Conditions, your misuse of our services or website, or any inaccurate information you have provided to us in the course of an engagement.
10. Termination
Either party may terminate an active service engagement by giving written notice to the other. In the event of client-initiated termination after commencement, the applicable fee conditions in Section 5 apply. lumarila reserves the right to terminate an engagement without refund if the client has materially breached these terms.
11. Dispute Resolution
In the event of a dispute, we ask that you first contact us directly to seek an informal resolution. Most concerns can be addressed through open communication. If a resolution cannot be reached informally, the dispute will be subject to the jurisdiction of the courts of Malaysia, and these terms are governed by the laws of Malaysia.
12. General Provisions
- Entire Agreement: These Terms and Conditions, together with any service confirmation, constitute the entire agreement between the parties.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure by either party to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign your rights under this Agreement without our prior written consent.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. Updated terms will be published on our website with a revised effective date. Continued use of our services after such publication constitutes acceptance of the updated terms.
